Terms of Service

These Terms of Service ("Terms") govern your access to and use of BorderETA, including the BorderETA mobile and web applications and any related services (collectively, the "Service"). By using the Service, you agree to these Terms.
1. Who We Are
BorderETA is operated by Jonathan Kim (sole proprietor) doing business as BorderETA, based in El Paso, Texas, United States. You can contact us at support@bordereta.live.
2. Eligibility
You must be at least 13 years old to use BorderETA. If you are between 13 and the age of majority in your jurisdiction, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. The Service is not directed to children under 13.
3. Your Account
You may use some features of BorderETA without an account. To submit reports, save preferences, or configure alerts, you must create an account.
You agree to provide accurate information when creating an account, to keep your password confidential, and to notify us promptly at support@bordereta.live if you suspect unauthorized access. You are responsible for activity that occurs under your account.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law.
- Submit false, misleading, or abusive community reports.
- Attempt to interfere with the Service, including by reverse engineering, scraping at high volume, denial-of-service attacks, or attempting to gain unauthorized access to our systems.
- Use the Service to harass, threaten, or harm others.
- Resell, sublicense, or commercially redistribute the Service without our written permission.
- Use automated tools to submit reports or interact with the Service in a way that simulates human use.
We may suspend or terminate accounts that violate these rules, with or without notice.
5. Wait Time Information — No Guarantees
BorderETA combines public data from U.S. Customs and Border Protection, public data from the Mexican government, traffic data from third-party providers, and predictions from our machine learning model. Wait times shown in the app are estimates and predictions, not guarantees.
You agree that BorderETA is not responsible for missed appointments, delays, financial losses, or any other consequences arising from reliance on wait time estimates. Always plan additional buffer time when crossing the border for time-sensitive purposes.
The Service is not a substitute for official information from CBP or Mexican border authorities. Border conditions can change suddenly due to security incidents, weather, infrastructure issues, or other factors that no estimate can predict.
6. User Content
When you submit a community report, you grant BorderETA a worldwide, non-exclusive, royalty-free license to display, store, and use that report to operate and improve the Service. You retain whatever rights you have in the underlying content.
You are responsible for the content you submit. Do not submit content that is unlawful, defamatory, infringing, or that you do not have the right to share.
We may remove reports that violate these Terms or that we determine in our discretion are inaccurate, abusive, or off-topic.
7. Intellectual Property
The BorderETA name, logo, app, website, and underlying software are owned by us and protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You may not copy, modify, or create derivative works of the Service except as expressly permitted by law.
8. Termination
You may stop using the Service at any time and delete your account in the app (Account tab → your profile → Delete account).
We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice, including for violation of these Terms. If we terminate the Service entirely, we will provide reasonable advance notice.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT WAIT TIME ESTIMATES ARE ACCURATE, COMPLETE, OR TIMELY. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BORDERETA AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS.
Some jurisdictions do not allow these limitations, in which case the limitations apply to the maximum extent permitted.
11. Indemnification
You agree to indemnify and hold harmless BorderETA, its operators, and its agents from any claim, demand, loss, or damages, including reasonable attorneys' fees, arising out of (a) your use of the Service, (b) your violation of these Terms, or (c) your violation of any third-party right.
12. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any dispute arising out of or related to these Terms or the Service will be resolved in the state or federal courts located in El Paso County, Texas, and you consent to the personal jurisdiction of those courts.
If you are a consumer in a jurisdiction whose laws give you the right to bring proceedings in your local courts, this section does not override that right.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you via in-app banner, push notification, or email before the changes take effect. The "Last updated" date at the top of these Terms reflects the most recent revision. Continued use of the Service after the effective date constitutes acceptance.
14. Miscellaneous
These Terms, together with our Privacy Policy, are the entire agreement between you and BorderETA regarding the Service. If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver of our right to do so later. You may not assign these Terms without our written consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets.
